Terms of Service - Vietnamese
1. QUY ĐỊNH CHUNG
Thỏa thuận: Khi đặt commission, bạn mặc định đồng ý với tất cả các điều khoản dưới đây.
File tách lớp : Nếu bạn cần file để làm Live2D, rigging hoặc chỉnh sửa, hãy báo cho mình ngay từ đầu nhé.
Tiến độ: Cập nhật qua Trello hoặc bảng trạng thái trên VGen.
Portfolio: Mình có quyền đăng sản phẩm hoàn thiện làm mẫu/portfolio trừ khi bạn chọn gói bảo mật (NDA).
File lưu giữ Commission sẽ được xóa sau 1 tháng hoàn thành.

2. NHỮNG THỨ CẦN THIẾT KHI ĐẶT COMMISSION
Vui lòng cung cấp các thông tin sau khi đặt hàng:
Phương tiện liên lạc (Email, Discord, Facebook, v.v...).
Character của bạn.
Mẫu thiết kế nhân vật.
Ý tưởng bạn muốn (pose, địa điểm, thời gian, trang phục,...).
Những lưu ý riêng của bạn.

3. QUY TRÌNH LÀM VIỆC
Đối với illustration
Khách gửi Brief và cọc 30% → Sketch color→ Khách gửi nốt 70%→ Render Gửi Final.
Đối với Model VTUBER
Khách gửi Brief và cọc 50% → Sketch color→ Khách gửi nốt 50%→ Render Gửi Final.

4. THANH TOÁN & CHỈNH SỬA
Phương thức: Chấp nhận PayPal, Visa và Chuyển khoản Ngân hàng (Bank Transfer).
Vui lòng gom tất cả yêu cầu chỉnh sửa vào một tin nhắn để tránh làm chậm tiến độ.
Lưu ý về giao tiếp: Nếu khách hàng cố tình không phản hồi (seen hoặc không rep) trong vòng 10 ngày, mình sẽ hủy commission và không hoàn tiền.
Đơn vị tiền tệ chấp nhận: USD | VND. Giá VND chỉ dành riêng cho khách hàng trong nước (Việt Nam).
Phương thức thanh toán: Qua hóa đơn PayPal. Tôi sẽ không bắt đầu làm việc cho đến khi nhận được thanh toán. Phí nền tảng sẽ được cộng thêm vào tổng đơn hàng.

5. QUYỀN SỬ DỤNG & THƯƠNG MẠI
Cá nhân: Đã bao gồm trong giá gốc.
Streaming/Kiếm tiền: +50% giá trị (Bắt buộc cho Vtuber/Streamer).
Kinh doanh (Merchandising): +100% giá trị (Bắt buộc nếu bán sản phẩm in hình vẽ).
Credit: Mình giữ bản quyền. Vui lòng ghi credit "Mara Hekate" khi sử dụng.

6. DEADLINE
Thời gian ước tính: Commission thường hoàn thành từ 2 - 3 tháng tính từ lúc chuyển khoản 100%.
Deadline cụ thể:
illustration: 2 - 3 tháng.
Model Vtuber 3 - 4 tháng.
Deadline gấp (≤ 15 ngày): Sẽ tính thêm phí tùy thuộc vào độ chi tiết của yêu cầu.

7. NGHIÊM CẤM
AI & NFT: Không dùng huấn luyện AI, Dataset scraping hoặc NFT.
Mạo danh: Không nhận vơ artwork là của bạn.
Nội dung: Không dùng cho nội dung thù ghét, NSFW hoặc phân biệt đối xử (trừ khi đã thảo luận).

Terms of Service - English
1. GENERAL TERMS
Agreement: By commissioning me, you automatically agree to all terms listed below.
Layered Files: If you require layered files (for Live2D, rigging, or editing), please inform me at the beginning of the process.
Progress: Updates will be provided via Trello or the VGen status board.
Portfolio: I reserve the right to post the final artwork as a sample/portfolio unless a Non-Disclosure Agreement (NDA) is purchased.
File Retention: Commission files will be deleted 1 month after completion.

2. REQUIREMENTS FOR COMMISSIONING
Please provide the following information when placing an order:
Contact method (Email, Discord, Facebook, etc.).
Your character references.
Character design sheets.
Your ideas (pose, setting, time, outfit, etc.).
Any specific notes or preferences.

3. WORKFLOW
For Illustrations:
Brief submission & 30% Deposit → Color Sketch → Remaining 70% Payment → Rendering & Final Delivery.
For VTuber Models:
Brief submission & 50% Deposit → Color Sketch → Remaining 50% Payment → Rendering & Final Delivery.

4. PAYMENT & REVISIONS
Payment Methods: I accept PayPal, Visa, and Bank Transfer.
Efficiency: Please consolidate all revision notes into a single message to avoid delays.
Communication Policy: If there is no response (read but no reply) within 10 days, the commission will be canceled without a refund.
Currency accepted: USD | VND. VND pricing is reserved exclusively for domestic clients in Vietnam.
Payment is via PayPal invoice. I will not start work until payment is received. A platform fee will be applied to the total order.

5. USAGE RIGHTS & COMMERCIAL USE
Personal Use: Included in the base price.
Streaming/Monetized Use: +50% of the total price (Required for Vtubers/Streamers).
Merchandising: +100% of the total price (Required if you sell products featuring the artwork).
Credit: I retain the copyright. Please credit "Mara Hekate" when using the artwork

6. DEADLINE
Estimated Timeline: Commissions are typically completed within 2 - 3 months starting from the date of 100% payment.
Specific Deadlines:
illustration: 2 - 3 months.
Model Vtuber 3 - 4 months.
Rush Orders (≤ 15 days): An extra fee will be applied depending on the complexity of the request.

7. PROHIBITED USES
AI & NFT: No AI training, dataset scraping, or NFT usage.
Claims: Do not claim the artwork as your own creation.
Content: No use in hateful, NSFW, or discriminatory content (unless previously discussed).

Private Commission: +30% of total price
During the process: Please review carefully and request any changes while the artwork is in progress.
Post-delivery: Free revisions are not supported after the final files have been sent. Any additional details requested after this point will incur extra fees.
Important Note: If non-commercial commissions are found to be used for unauthorized commercial purposes, I reserve the right to reclaim those products.
